Greetings!
These are the most common inquiries received about the Public Records section.
- Is this the same as filing at the courthouse?
Yes! When you file at the courthouse, they keep your documents on file for other parties to make a public records request. For an online publication such as this one, your file is publicized for all parties to take notice of. In the age of information, you may always point another party to where they may take legal notice of your documents in times of peace and in the midst of dispute.
public notice
"a notice providing information for the public that is widespread throughout all types of media; it will be in newspapers, on radio braodcasts, and television broadcasts. It includes items such as Lottery results and Development applications." Black's Law Dictionary, 2nd Ed.
see https:⁄⁄www.wikipedia.org⁄public_notice - Why did the local court clerk reject my filing?
This is because of the filing clerk's ignorance of the law and proper procedure and can be attributed to an overall lack of regard for people who choose to record their own affidavits and other legal documents. They broke the law when they rejected your filing per 28 U.S.C. ยงยง 2071, 2076. Their jobs are ministerial and custodial and not judicial in nature. Fortunately for us, this is good for our business. That's what brings your our way!
- Why would I want to order an Affidavit of Publication?
As a matter of enforcing judicial notice upon a court or another public entity representing the executive branch of government, you can utilize our Affidavit of Publication by sending it to the relevant parties along with original copies of your document(s). This step certifies and affirms, jointly and⁄or severally, that your document was published here at its home. Generally, each State has codified what such an affidavit shall contain for electronic publications that host such public notices. These Code sections usually apply in the same manner to newspapers.
- I heard that I should use a newspaper. Is this good enough?
Yes.
- Can I ask questions about my specific problem?
Yes, you may; however, the best questions are the ones that demonstrate your thoughts and provide the necessary information about steps you have taken or plan to take to fix your problem. I will respond much to your satisfaction, but I do have limits on the amount of responses I can send for free; therefore, I do reserve the right to end the discussion or to require you to pay a small fee for consultation.
- Is there a file submission page for me to use?
No, there is not one available yet. To build such a form would require extensive back–end programming, but this may be feasible at some point in the future. All of the existing pages are the current main focus of site development.
Thank you for all of your support.
